An experienced NASCAR driver, John Wes Townley, was arrested on Feb. 7, accused of DUI. Police claim that the man committed a number of traffic violations prior to a collision into a telephone pole. He suffered injuries in the crash which caused bleeding on his feet. Many Illinois residents are NASCAR fans, and may be familiar with this driver. This is a reminder that anyone, even professional drivers, can violate driving laws.
Unfortunately, in addition to facing prosecution for DUI, he has also been summarily suspended by RAB Racing, which had contracted with him to drive in the NASCAR Camping World Truck Series in 2012. NASCAR itself is also discussing whether any disciplinary action is needed.
These actions have been taken against the driver despite the constitutional presumption of innocence unless one is found guilty by a jury of their peers after having their day in court. When alcohol is involved, it is also all too true that even good people can make a mistake or overindulge, without any intent to do wrong. In such cases, counseling for alcohol abuse or alcoholism may be more helpful than a punitive imposition of jail time.
It also will seem unfair to many NASCAR fans that this driver, in addition to facing criminal prosecution and the glare of publicity, should face ramifications negatively impacting his professional career and livelihood. This is especially true, especially since the accident occurred completely outside the arena of NASCAR driving. In some cases, charges and punishments are issued that may be out of proportion to any offense. Seeking legal help from a professional may prevent this from happening.
